Terms and Conditions of Use for Harmix
1. Who We Are and Purpose of Harmix
Welcome to Harmix, a SaaS platform for ESG (Environmental, Social, and Governance) reporting. The harmix.eu website (“Site”) and the “HARMIX” trademark (“Trademark”) are the property of CASSANDRA18 S.R.L., with registered office in Chieri (TO), Corso Torino 107, registered with the Chamber of Commerce Register of Companies of Turin, Tax Code and VAT number 11880710014, R.E.A. TO – 1248273, with share capital of Euro 10,000.
The Site and the Trademark are licensed to 5YEARS S.R.L. with registered office in Asti, Corso Ivrea 90, registered with the Chamber of Commerce Register of Companies of Asti, Tax Code and VAT number 01687080059, R.E.A. AT – 135215, with share capital of Euro 1,500, a company owned by CASSANDRA18 S.R.L.

Harmix is designed to simplify and enhance the efficiency of corporate compliance management, process traceability, and internal collaboration. The Platform enables client companies (the "Clients") to digitize and automate workflows through shared tools, accessible also to internal or external stakeholders (the "Users" and, where applicable, the "Stakeholders").
These Terms and Conditions of Use (the "Terms of Use") govern access to and use of the Platform by each registered User.
By using the Platform, the User expressly accepts these Terms of Use. Upon registration, the User will receive a copy of the Terms by email at the address provided.
Use of the Platform is reserved for adults with full legal capacity, including on behalf of the company they represent. Each User assumes full responsibility for the truthfulness of the information provided.
All connection and service costs required to access and use the Platform are borne exclusively by the User.
2. Account
To use the Platform, the User must create a personal account (the "Account"). During registration, a valid email address and password must be provided, along with any other identifying information.
The User is responsible for keeping credentials confidential and for all activity conducted through the Account. Any activity performed through the Account is presumed to be carried out by the User. The Company disclaims all liability for unauthorized access resulting from the User’s failure to protect their credentials.
The User may deactivate their Account at any time through the dedicated section of the Platform or by sending a request to privacy@5years.it.
The Company reserves the right to suspend or close an Account in case of misuse, violation of these Terms, or unauthorized access.
3. Permitted Use of the Platform
The User agrees to use the Platform solely for lawful purposes, in accordance with these Terms and applicable laws.
The following actions are prohibited:.
1. Attempting to bypass security measures, decode, decompile, or reverse engineer the Platform;.
2. Creating fake or multiple accounts;.
3. Posting false, unlawful, defamatory, or infringing content;.
4. Using the Platform for unfair competition;.
5. Compromising the integrity or functionality of the system or third-party data...
Any violation may result in automatic termination of the contract and immediate suspension of Services.
4. Limitation of Liability
The Platform is provided "as is." The Company does not guarantee it is error-free or that it will meet the specific needs of Users.
The Company shall not be liable for:
• Indirect damages, loss of profits or data;
• Malfunctions due to third-party providers, outages, or force majeure;
• Improper or non-compliant use by the User.
In any case, the Company’s total liability shall not exceed the amount paid by the User in the 12 months preceding the event giving rise to the claim.
5. Intellectual Property Rights
All content on the Platform, including software, graphics, logos, text, and trademarks, is the exclusive property of the Company or its licensors. No usage rights are granted beyond what is specified in these Terms.
Any unauthorized use, including reproduction, distribution, or modification of content, will be prosecuted in accordance with the law.
6. Third-Party Links
The Platform may contain links to third-party sites. The Company is not responsible for the content, security, or availability of such sites. Access to external links is at the User’s own risk.
7. Data Processing
Personal data provided through the Platform will be processed in accordance with Regulation (EU) 2016/679 (GDPR) and applicable Italian legislation.

8. Changes to the Terms of Use
The Company reserves the right to modify these Terms at any time. Changes will be effective upon publication on the Platform. Continued use of the Platform constitutes implicit acceptance of the changes.
If the User does not agree to the new conditions, they may stop using the Platform and deactivate their Account.
9. Security
The Company implements appropriate technical and organizational measures to protect User data. However, no system is entirely risk-free: the User accepts the residual risk associated with internet data transmission.
10. Governing Law and Jurisdiction
These Terms are governed by Italian law. Any dispute will be subject to the exclusive jurisdiction of the Court of Turin, unless otherwise provided by mandatory law.
